Terms and Conditions General Ticket and Event Terms and Conditions of 
pro-log GmbH, Münnerstädter Str. 39, 97688 Bad Kissingen, Germany, 
in the online shop at shop.abenteuer-allrad.de.

1. Scope 

1.1. For visits to the “ABENTEUER & ALLRAD” trade fair and lectures and special events organized there by pro-log, the following General Ticket and Event Terms and Conditions in the version valid at the time of ordering apply exclusively, which the customer and any persons represented by them representative (hereinafter also referred to as “visitor” or “ticket holder”) by ordering, purchasing, or using the tickets. The customer's terms and conditions do not apply, even if we do not separately object to their validity in individual cases.

1.2. These GTC do not apply to offers, orders, purchase contracts, and deliveries of goods via our online shop. Our separate General Terms and Conditions for the Purchase of Goods apply to these. 

1.3. The sole contract language is German. If translations of these GTC or other contract-related declarations and documents have been made into languages other than German, the German version shall be authoritative for the parties. 

2. Ticket purchase 

2.1. Ticket sales by pro-log are aimed exclusively at adults with a delivery address in Germany and are valid “while stocks last.” 

2.2. Advance ticket sales take place exclusively online via our online shop mentioned above. 

2.3. Each ticket is personalized, i.e., issued in the name of a specific visitor. When placing your order, you as the customer must enter the full first and last names of the visitor(s) or ticket holder(s) in the order fields provided. 

2.4. pro-log reserves the right to limit ticket sales or the number of tickets per order for certain lectures and special events. 

2.5. Any customer ordering on behalf of or in the name of a third party hereby guarantees pro-log for any payment claims arising from the order placed. 

2.6. The offer to conclude a contract is made by the customer as soon as they click on the “Place order” button during the ordering process. The purchase contract is concluded when pro-log confirms the order by email. 

2.7. The prices stated on the website include statutory value added tax and any additional service and shipping costs and are displayed in the shopping cart when the order is placed. The prices and costs stated at the time of ordering are decisive. 

2.8. Tickets for lectures and other special events subject to a charge are only valid in conjunction with a ticket to the “ABENTEUER & ALLRAD” trade fair that is valid on the day of the lecture event. 

2.9. The customer warrants that all information provided by them when placing the order is true and complete, in particular information regarding any discounts. pro-log is entitled to check the conditions for discounts in an appropriate manner and to refuse admission to ticket holders who do not meet the requirements for the discount or to demand additional payment. In the event of refusal of admission, any claims by the ticket holder—of whatever nature, in particular claims for reimbursement of the costs of purchasing the ticket and claims for damages—are excluded. 

2.10. Once the order process has been completed and payment has been made, the tickets can be downloaded immediately in PDF format. To download, view, and print the tickets, you will need a software program that can process PDF files, e.g., Adobe Acrobat Reader. You can download the latest version of this program free of charge from the Adobe website, subject to the terms and conditions specified there. 

2.11. Tickets can be printed out or saved on a smartphone. Each ticket (except for free tickets for children) contains a QR code. The ticket with the QR code is scanned and validated by pro-log at the entrance to the trade fair, thereby granting the customer access to the exhibition grounds. 

3. Terms of payment 

3.1. The total price of the order, including all costs, is due for payment immediately upon placing the order. If immediate payment is not made, pro-log is entitled to cancel the order without replacement, of which the customer will be informed by email. 

3.2. Payment can be made using any of the payment methods offered on our website, at the customer's discretion. If we use third-party payment providers/payment service providers for payment methods, the general terms and conditions of the respective service provider shall also apply to the payment transaction. 

3.3. If you select the “bank transfer” payment method, you will receive bank details to which the payment must be made. If the transfer is not made within the set payment period, the order will be canceled. 

4. Collection, storage, and processing of your personal data
 

4.1. Our privacy policy applies, which you can view and download on our website. 

4.2. In order to execute and process an order and personalize the tickets, we require the following data from you during the ordering process: - Private customer or company - First and last name - Email address - Postal address - Telephone number 

4.3. You can order goods and/or services in our online shop as a guest or new customer or as a registered customer. As a registered customer, you do not have to enter your personal data every time, but can simply log in to your customer account before or during an order with your email address and the password you chose when registering. If you would like to create a customer account, we require the data specified in 4.2 as well as a password of your choice. 

4.4. Without your separate consent, we will use the data you provide exclusively for the fulfillment and processing of your order(s), for example to send the tickets to the email address you have provided. If you pay by bank transfer, we will also use your bank details to process the payment. 

4.5. Any further use of your personal data for advertising, market research, or to tailor our offers to your needs requires your express consent. If we give you the opportunity to give such consent before placing your order and you do so, this is done voluntarily and can be accessed on our website and revoked by you at any time. 

4.6. The data you provide will remain stored in the customer account you have created until you delete it yourself. If your personal details change, you are responsible for updating them yourself. All changes can be made online after logging in under “My Account.” In addition, or in the event that you only place an order as a guest or new customer without creating a customer account, we will only store your data within the scope of our tax and commercial law obligations. 

5. Prohibition of commercial use 

5.1. The customer expressly undertakes and assures that they will purchase and use the tickets exclusively for private purposes.

5.2. The commercial resale of tickets is not permitted. pro-log may refuse to issue tickets to persons and cancel orders from customers (unilateral right of withdrawal) who trade tickets commercially without the consent of pro-log or who make tickets available to such persons or if there is reasonable suspicion that specific conditions set by pro-log, which were pointed out during the advance sale, are being violated or attempts to circumvent them (e.g., violation of the restriction on the number of tickets per customer, violation of the terms and conditions, in particular the prohibition on resale, etc.). Reasonable suspicion exists in particular if the customer offers tickets on Internet resale platforms or if their purchasing behavior suggests that the tickets are not being purchased for private use. The declaration of cancellation/withdrawal may also be made implicitly by crediting the amounts paid. Sections 346 et seq. of the German Civil Code (BGB) apply to the aforementioned right of withdrawal, with the exception of Section 350 BGB. 

6. No right of withdrawal, cancellation

6.1. The right of withdrawal in distance selling pursuant to Section 355 BGB does not apply to the purchase of tickets, as these services are so-called leisure services within the meaning of Section 312g (2) No. 9 BGB, for the provision of which a specific date or period is determined. 

6.2. This means that if you purchase tickets for the trade fair, events, or lectures from us, pro-log GmbH, as the organizer of the Abenteuer & Allrad trade fair, there is no right of withdrawal. Every ticket order is therefore binding immediately after confirmation by us and obliges you to pay for the tickets ordered. 

6.3. The return of tickets and reimbursement of the ticket price are excluded, unless the event does not take place for reasons for which pro-log is responsible. In this case, the customer will be credited with the ticket price paid by them using the payment method selected by them when ordering. 

6.4. No replacement will be provided for lost tickets. 

7. Event and visitor conditions 

7.1. Visitors enter the trade fair and exhibition grounds at their own risk. 

7.2. By purchasing or using a ticket and entering the trade fair and exhibition grounds, visitors declare that they accept and will observe the additional house and site rules posted at the event venue. 

7.3. pro-log exercises domiciliary rights throughout the entire exhibition grounds. When parking, the instructions of the security personnel must be observed. Visitors park their vehicles at their own risk. pro-log is entitled to issue expulsion orders and bans or to take other appropriate measures within the scope of these domiciliary rights in the event of violations of the event and visitor conditions as well as the house and site rules. In particular, visitors may be expelled from events or the exhibition grounds if they disrupt them, harass other visitors or exhibitors, or have violated the event and visitor conditions in any other significant way or repeatedly. Admission may be refused if there is reasonable suspicion that the visitor will disrupt the event or harass other visitors, or if they are visibly intoxicated. In such cases, the ticket price will not be refunded. We reserve the right to refuse admission for other important reasons (against refund of the ticket price). 

7.4. Subject to any other announcements, admission to lecture events is 20 minutes before the start. Admission is no longer possible after the lecture has begun. Seating is unreserved. There is no entitlement to a specific seat. If, in exceptional cases, seat tickets are sold, visitors may only occupy the seat indicated on their ticket. If a visitor occupies a seat for which they do not have a valid ticket, pro-log may charge the difference or expel the visitor from the lecture event without the visitor being entitled to a refund of the ticket price. The ticket loses its validity upon leaving the lecture premises.

7.5. It is generally prohibited to bring glass containers, cans, pyrotechnic objects, torches, cutting and stabbing weapons, potential projectiles, other dangerous objects, and alcoholic beverages. Failure to comply may result in the visitor being expelled from the event premises. A security check will take place at the entrance. Security personnel are instructed to carry out body searches. 

7.6. Audio, photo, and video recordings for commercial purposes are strictly prohibited. Abuse will be prosecuted. Exceptions will be announced by pro-log. Upon entering the event grounds, visitors agree to be filmed or photographed. Each visitor irrevocably consents to the free use of their image and voice for all current and future media in photographs, live broadcasts, broadcasts, and/or recordings of images and/or sound created by pro-log or its agents in connection with the event.

7.7. pro-log reserves the right to cancel the event due to significant complications, dangers, or impairments caused by unforeseeable and extraordinary circumstances such as war, civil unrest, epidemics, monetary, trade policy, or other sovereign measures, natural disasters, accidents, destruction of accommodation, strikes, lockouts, operational disruptions, or similar incidents, regardless of whether these occur at pro-log or its service providers, to relocate or cancel the event locally and/or in terms of timing. 

7.8. The ticket loses its validity upon leaving the event venue. 

7.9. pro-log is not responsible for lost or stolen items, unless pro-log acted with gross negligence or intent. Items of any kind found on the exhibition grounds must be handed in to the exhibition staff. The loss of items must be reported to the exhibition staff. Further handling of lost property is governed by the statutory provisions (Sections 978 et seq. of the German Civil Code). 

8. Questions and complaints

9. Limitation of liability 

9.1. pro-log, its legal representatives, and its vicarious agents shall only be liable for damage suffered by a visitor on the exhibition grounds and in the rooms there in cases of intent and gross negligence. This limitation of liability does not apply to claims arising from injury to life, limb, or health. 

9.2. In the event of a slightly negligent breach of a primary obligation or a secondary obligation, the breach of which jeopardizes the achievement of the purpose of the contract or the fulfillment of which is essential for the proper execution of the contract and on the observance of which the visitor could rely (hereinafter referred to as “essential secondary obligation”), pro-log's liability shall be limited to damages typical for this type of contract and foreseeable at the time of conclusion of the contract. pro-log shall not be liable for the slightly negligent breach of contractual secondary obligations that are not essential secondary obligations. 

10. Final provisions 

10.1. The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods, if (a) you have your habitual residence in Germany, or (b) your habitual residence is in a country that is not a member of the European Union. If you have your habitual residence in a member state of the European Union outside Germany, German law shall also apply, whereby mandatory consumer protection provisions of the country in which you have your habitual residence shall remain unaffected. 

10.2. The European Commission provides a platform for online dispute resolution (ODR platform), which you can find at http://ec.europa.eu/consumers/odr/. Our email address can be found above. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. 

10.3. The place of performance and jurisdiction for merchants, legal entities under public law, or special funds under public law is the court responsible for Bad Kissingen. This also applies if the customer does not have a general place of jurisdiction in Germany or if they move their place of residence or habitual abode to a location outside Germany after conclusion of the contract or if their place of residence or abode is unknown at the time the action is brought. However, we are also entitled to choose any other legally permissible place of jurisdiction.
